These Terms and Conditions of Use ("Terms of Use") of the website www.birbhumpharmacyschool.in and/or any associated mobile application ("App") govern the relationship between Birbhum Pharmacy School ("the Institution," "we," "us," or "our") and the users/registrants of the Website/App ("You," "Your," "Yourself," or "User"). They describe the terms on which the Institution offers you access to the Website/App and the services (as defined below).

Note: All defined words in the Privacy Policy and any Additional Terms available on the Website/App continue to have the same meaning in these Terms of Use.

Your use of the Website/App or the services provided signifies your acceptance of these Terms of Use and your agreement to be legally bound by the same.

Access to the Website/App and the services is offered to you conditioned on acceptance of all the terms, conditions, and notices contained in these Terms of Use, along with the Privacy Policy and any other applicable terms and conditions displayed on the Website/App ("Additional Terms"), and any amendments made by the Institution at its sole discretion and posted on the Website/App.

The Institution shall not be required to individually notify you of changes made to the Terms of Use and/or Additional Terms. The revised Terms of Use and/or Additional Terms shall be made available on the Website/App. Your use of the Website/App and the services is subject to the most current version at the time of such use. You are requested to regularly visit the Website/App to view the most current Terms of Use and Additional Terms.

By (i) using this Website/App or any facility or service provided through this Website/App in any way, or (ii) merely browsing the Website/App, you agree that you have read, understood, and agreed to be bound by these Terms of Use and/or Additional Terms. If you do not agree, you are prohibited from accessing or using the Website/App.

2. Eligibility of Use

The user represents that they are of legal age to enter into a binding agreement and are not prohibited from entering into such agreements as per Indian laws and/or the Institution. "Incompetent persons to contract," as defined under Section 11 of the Indian Contract Act, 1872—including minors, persons declared insolvent, and persons of unsound mind—shall not be eligible to access the Website/App. If the user is under eighteen (18) years, access may be through a legal guardian as applicable under law.

It is not necessary for you to register if you are merely visiting the Website/App for browsing purposes. To access certain services, registration and creation of an account may be necessary.

The Institution reserves the right to deny access to the Website/App to any user or terminate access to existing users at any time without giving any reason whatsoever.

3. Use of Website/App and User Obligations

Provided that you comply with these Terms of Use and/or Additional Terms, the Institution grants you a non-exclusive and limited license to use the Website/App. This license does not include downloading or reproducing content for any other person’s use or benefit. You may not circumvent any mechanism used to restrict access to the Website/App. Any use that does not comply with these Terms will terminate your rights to use the Website/App.

You acknowledge that you will use the Website/App and services only for purposes permitted by these Terms and by applicable laws and regulations.

You acknowledge that access to the Website/App may expose you to user-generated content that you may consider offensive or unacceptable. The Institution cannot control user-generated content and is not liable for such content; it may be reported to the Grievance Officer.

If the Website/App allows you to post or upload material, you undertake to ensure that such material is not offensive and is in accordance with applicable laws. You undertake not to:

• Defame, abuse, harass, threaten, or otherwise violate the legal rights of others.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation.
• Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, libelous, slanderous, infringing, obscene, indecent, or unlawful content.
• Upload files containing material protected by intellectual property laws unless you own/control the rights or have all necessary consents.
• Upload or distribute files containing software viruses or other code designed to interrupt, destroy, or limit functionality of the Website/App or any computer resource.
• Engage in any activity that interferes with or disrupts access to the Website/App or its services.
• Attempt to gain unauthorized access to any portion of the Website/App or systems connected to it by hacking, password mining, or other illegitimate means.
• Probe, scan, or test the vulnerability of the Website/App or breach security/authentication measures.
• Disrupt or interfere with the security of, or otherwise cause harm to, the Website/App, systems, resources, servers, or networks connected to it.
• Collect or store data about other users in connection with prohibited conduct.
• Host, display, upload, modify, publish, transmit, update, or share any information that belongs to another person and to which you have no right.
• Host, display, upload, modify, publish, transmit, update, or share content that is grossly harmful, harassing, defamatory, obscene, pornographic, invasive of privacy, hateful, or otherwise unlawful.
• Host, display, upload, modify, publish, transmit, update, or share content that harms minors.
• Host, display, upload, modify, publish, transmit, update, or share content that threatens the unity, integrity, defense, security, or sovereignty of India; public order; or causes incitement to a cognizable offense.
• Host, display, upload, modify, publish, transmit, update, or share content that deceives or misleads users about its origin or that is grossly offensive or menacing.
• Use the Website/App for any unlawful purpose or to solicit the performance of any illegal activity.
• Conduct or forward pyramid schemes, junk emails, chain letters, unsolicited mass mailings, or spam.
• Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such a manner.
• Falsify or delete author attributions, legal notices, or proprietary designations of uploaded material.
• Violate any code of conduct or guidelines applicable to any service.
• Violate any applicable laws or regulations in force within or outside India.
• Violate these Terms of Use and/or Additional Terms.
• Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website/App.

You are solely responsible for any breach of your obligations and for the consequences (including any loss or damage) that the Institution, its users, or any third party may suffer.

The Institution may modify or discontinue all or part of the Website/App, charge/modify/waive fees (if any), or offer opportunities to some or all users.

"Your Information" means any information you provide to the Institution or other users during your access or use of the Website/App. You grant the Institution a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sublicensable license to exercise copyrights, publicity rights, and database rights in your information, in all media, in accordance with these Terms and Additional Terms.

In the event you become aware of any content/transaction that violates these Terms and/or applicable law, you shall take steps to inform the Grievance Officer.

You shall ensure compliance with applicable provisions of the Information Technology Act, 2000 and rules made thereunder, and all other applicable laws and regulations.

You acknowledge that the Institution shall not be liable for user-submitted content or for defamatory, offensive, or illegal conduct of any user or third party.

4. Intellectual Property Rights

The trademarks, logos, images, service marks, and other branding elements on the Website/App belonging to Birbhum Pharmacy School are Trademarks of the Institution and shall not be used in association with any goods/services unrelated to or not endorsed by the Institution, nor in any manner that may tarnish its image. Any trademarks appearing on the Website/App that are not owned by the Institution belong to their respective owners.

Unless otherwise stated, Birbhum Pharmacy School is the sole and exclusive owner of intellectual property rights in the Website/App and its content, including (without limitation) text, graphics, icons, hyperlinks, databases, and source code. Your use of the Website/App does not grant ownership of any content, code, data, or material accessible through it.

Commercial or promotional use, distribution, reproduction, or exploitation of the Website/App or its content is prohibited without prior written permission. You must not alter or remove any copyright, trademark, patent, or other notices contained on the Website/App.

To the maximum extent permitted by law, the Institution shall not be liable for user content or for misuse, loss, modification, or unavailability of user content. The Institution does not warrant the completeness or accuracy of information on the Website/App and shall not be liable for damages resulting from use of information, content, products, or services available through it.

7. Indemnity

You will indemnify, defend, and hold harmless Birbhum Pharmacy School, its affiliates, and their respective officers, directors, agents, and employees against losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms and/or Additional Terms or your use of the Website/App.

8. Limitation of Liability

To the maximum extent permitted by law, Birbhum Pharmacy School, its officers, directors, employees, affiliates, and assigns shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages resulting from access to or use of the Website/App, errors/inaccuracies, unauthorized access, viruses, interruptions, disputes between users, or defamatory/offensive/illegal conduct of any user.

9. Violation of the Terms of Use

The Institution may deny access, restrict, suspend, and/or terminate any user and prevent access to the Website/App at its sole discretion. In the event of violation, the Institution may pursue all available remedies including recovery of amounts due and taking legal action.

10. Linking to Third-Party Websites

You may be able to link from the Website/App to third-party websites and third-party websites may link to the Website/App ("Linked Sites"). The Institution has no responsibility for content, products, services, or materials provided through Linked Sites.

Links to Linked Sites do not constitute an endorsement or sponsorship by the Institution.

• You are not permitted to link directly to images hosted on the Website/App using inline linking methods.
• You agree not to download or use images hosted on this Website/App or Linked Sites for any purpose, including posting on another site.
• The Institution may require any link to the Website/App to be discontinued and may revoke the right to link at any time.

11. Privacy Policy

12. Dispute Resolution

The governing law of these Terms of Use and other Additional Documents shall be the laws of India. Any disputes arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the competent courts in Birbhum, West Bengal.

13. Notice

All notices from the Institution will be served by email or by general notification on the Website/App. Any notice provided to the Institution should be sent to Birbhum Pharmacy School at the contact details provided below or at the address of the Institution.

14. Assignment

You cannot assign or otherwise transfer these Terms of Use and/or Additional Terms or any rights granted hereunder to any third party. The Institution's rights under these Terms are freely transferable by the Institution without requiring your consent.

15. Severability

If any provision is found unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remainder shall continue in full force and effect.

Failure by the Institution to enforce any provision shall not constitute a waiver of that provision or any related right.

When you visit the Website/App or send emails to the Institution, you communicate electronically. You consent to receive communications electronically. The Institution may communicate by email or by posting notices on the Website/App. You agree that electronic communications satisfy legal requirements for written communications.

18. Force Majeure

The Institution shall have no liability for interruption or delay in access to the Website/App due to causes beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, and power failures.
